(Last updated Jul 18, 2023) These terms of service create an agreement and understanding (the “Agreement”) between you (“customer”) and Scot Mini Cabs (“Scot Mini Cabs,” “we,” “us” or “our” as the pronoun may be) governing your use of our application and website.

 
1. Accepting Terms of Use
   1. IMPORTANT: BY USING OUR SERVICE, YOU AGREE THAT YOU HAVE CAREFULLY READ, UNDERSTOOD, AND ACCEPTED THESE TERMS AND CONDITIONS. FURTHERMORE, YOU AGREE TO THE REPRESENTATIONS MADE BY YOURSELF BELOW. IF YOU DO NOT AGREE TO OR FALL WITHIN THE TERMS OF USE OF THE SERVICE (AS DEFINED BELOW) AND WISH TO DISCONTINUE USING THE SERVICE, PLEASE DO NOT CONTINUE USING THIS WEBSITE OR SERVICE.
   2. The terms and conditions stated herein (collectively, the “Terms of Use” or this “Agreement”) create a legal agreement between you and Scot Mini Cabs. To use this Service (as defined below), you must agree to the Terms of Use provided below. By using the websites provided by our company, and accessing or using any associated services or features provided by Scot Mini Cabs, you acknowledge and agree to be bound by the Terms of Use, and any future changes and additions to this Terms of Use as published from time to time through the website.
   3. We reserve the right to modify, vary, and change the Terms of Use or its policies relating to the Service at any time. Such modifications, variations, and changes to the Terms of Use or its policies relating to the Service shall be effective upon the posting of an updated version on the website. You accept that it shall be your responsibility to check and review the Terms of Use regularly and the Terms of Use applicable to any country where you use the Service. Your continued use of the Service after any such changes, whether or not reviewed by you, shall constitute your consent and acceptance of such changes. You further agree that usage of the Service in the Alternate Country shall be subject to the Terms of Use prevailing for the Alternate Country, which can be found on the website.
    
2. Booking Process
   1. Users must provide accurate and complete information during the booking process
   2. No refund will be provided if the booking is canceled less than 8 hours prior to the trip.
   3. The airport transfer booking includes a waiting time of 45 minutes. After an additional 20 minutes of waiting time, a charge of 20 pounds will apply.
   4. There is a charge of 40 pounds for the meet and greet service.
   5. The standard waiting time for non-airport rides is 15 minutes. If the passenger is a no-show after 15 minutes, the ride will be considered canceled.
   6. All payments must be made in advance through the available payment methods, and cash payments are not accepted.
   7. There is a charge of 10 pounds for the provision of a baby seat.
    
3. Eligibility
   1. By using the Service, you represent and warrant that you are legally entitled to accept and agree to the Terms of Use, and that you are at least eighteen (18) years old. The Service is not available to persons under the age of eighteen (18) or those who are forbidden for any reason whatsoever to enter into a contractual relationship. You further represent and warrant that you have the right, authority, and capacity to use the Service and to abide by the Terms of Use. You confirm that all the information you provide shall be true and accurate. Your use of the Service is for your own sole, personal use. You undertake not to authorize others to use your identity or user status, and you may not assign or otherwise transfer your user account to any other person or entity. When using the Service, you agree to comply with all applicable laws in the country, state, and city in which you are present while using the Service.
   2. You agree to only access the Service using authorized means. It is your responsibility to ensure that you are using the correct and compatible software for accessing the Service on your web-enabled device. Scot Mini Cabs is not liable if you encounter compatibility issues or if you use unauthorized software to access the Service. Scot Mini Cabs reserves the right to deny access to the Service if you use incompatible or unauthorized software or access the Service for purposes other than its intended use on the web.
 
4. Prices and Payments
   1. Scot Mini Cabs uses a payment system that clearly shows the cost of the service ordered, and it is not negotiable. Scot Mini Cabs drivers hold the right to charge an extra fee if there’s an unusual delay or change of destination from the actual details provided during the service booking, and only Scot Mini Cabs drivers can accept this quoted price.The “median ride price” displayed to you is the median of the rates transportation network companies are offering to the general public for the exact or approximate distance you selected. These rates are based on the time you requested a ride and the area you selected. We make no guarantee or warranty regarding the accuracy or completeness of the data used or provided.
   2. You further agree to use your best efforts to do everything necessary and required by the relevant laws to enable, assist, and/or defend Scot Mini Cabs in claiming or verifying any input tax credit, set off, rebate, or refund in respect of any taxes paid or payable in connection with the Service supplied under this Agreement.
   3. All payments made for the use of the Service are non-refundable, except as expressly stated otherwise in these Terms of Use. In the event that you have a dispute with a driver or transportation provider, you agree to address such dispute directly with the driver or transportation provider. Scot Mini Cabs will not be responsible or liable for any refunds, damages, or claims arising out of or related to such disputes.
   4. You acknowledge that Scot Mini Cabs may modify the prices for the Service at any time in its sole discretion. Any changes to the prices will be notified to you through the website, and such changes will take effect immediately upon notification.
 
5. User Conduct
   1. You agree to use the Service only for lawful purposes and in accordance with these Terms of Use. You shall not use the Service in any way that may impair, disrupt, or damage the Service or interfere with any other party’s use and enjoyment of the Service. You shall not engage in any conduct that could constitute a criminal offense or give rise to civil liability.
   2. You agree not to misuse or abuse the Service, including but not limited to:a) Using the Service for any unauthorized or illegal purposes. b) Interfering with or disrupting the integrity or performance of the Service or the data contained therein. c) Attempting to gain unauthorized access to the Service or its related systems or networks. d) Reverse-engineering, decompiling, disassembling, or otherwise attempting to derive the source code of the Software. e) Using the Service to harass, abuse, or harm others. f) Engaging in any fraudulent or deceptive activities. g) Violating any applicable laws or regulations.
   3. Scot Mini Cabs reserves the right to suspend, restrict, or terminate your access to the Service at any time, without notice, if we reasonably believe that you have violated these Terms of Use or engaged in any prohibited conduct.
 
6. Intellectual Property
   1. The Service, including all content and materials contained therein, is protected by intellectual property laws and belongs to Scot Mini Cabs or its licensors. You acknowledge and agree that you do not acquire any ownership rights or licenses to the Service or any of its components.
   2. You may not use, reproduce, distribute, modify, or create derivative works of the Service or any part thereof without the prior written consent of Scot Mini Cabs.
 
7. Limitation of Liability
   1. To the maximum extent permitted by applicable law, in no event shall Scot Mini Cabs or its directors, officers, employees, agents, or affiliates be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or in any way connected with your use of the Service, whether based on contract, tort, strict liability, or any other legal theory.
   2. Scot Mini Cabs shall not be liable for any delay or failure to provide the Service due to causes beyond its control, including but not limited to acts of God, natural disasters, war, terrorism, riots, civil disturbances, labor disputes, or any other event of force majeure.
 
8. Governing Law and Dispute Resolution
   1. This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which Scot Mini Cabs operates.
   2. Any dispute, controversy, or claim arising out of or relating to this agreement or the breach, termination, or invalidity thereof shall be resolved by arbitration in accordance with the rules of the arbitration authority designated in the jurisdiction in which Scot Mini Cabs operates.
   3. The language of the arbitration shall be English, and the arbitration award shall be final and binding on the parties.
 
9. Severability
   1. If any provision of these Terms of Use is held to be invalid, illegal, or unenforceable, such provision shall be deemed severed from these Terms of Use and the remaining provisions shall remain in full force and effect. Please review these terms carefully. By continuing to use our services, you indicate your acceptance of these terms and conditions. If you do not agree to these terms, please refrain from using our website and services.
